These Website Terms of Use ("Terms") govern your access to and use of the website operated by Lovewood LLC, doing business as Buffalo Baths ("Buffalo Baths," "Company," "we," "us," or "our"), including any pages, booking functions, forms, content, communications, tools, applications and other services and the features therein made available through the website (collectively, the "Website").
Please read these Terms carefully. By accessing or using the Website, making a reservation, purchasing a product or service, submitting information, or otherwise interacting with the Website, you agree to these Terms.
If you do not agree to these Terms, please do not use the Website.
1. About Buffalo Baths
Buffalo Baths operates an appointment-based private outdoor soaking experience in Portland, Oregon.
The Website allows visitors and guests to learn about Buffalo Baths, communicate with us, make reservations, purchase available services or products, complete required documents, and prepare for visits.
Buffalo Baths provides recreational and wellness-oriented services only. We do not provide medical care, physical therapy, counseling, diagnosis, treatment, or other healthcare services.
Nothing on the Website or communicated by Buffalo Baths is intended to constitute medical advice or substitute for advice from an appropriately qualified healthcare professional.
2. Eligibility
You must have the legal capacity to enter into a binding agreement to make a reservation or purchase through the Website.
Eligibility to physically use the Buffalo Baths facilities is separately governed by the Guest Participation Agreement, Assumption of Risk, Release of Liability, and Facility Policies ("Guest Agreement").
You agree to provide accurate, current, and complete information when making reservations, purchasing services, completing forms or agreements, or otherwise communicating with Buffalo Baths.
3. Reservations
Use of Buffalo Baths facilities is by reservation unless Buffalo Baths expressly provides otherwise. Reservations are subject to:
availability;
operating hours;
guest limits;
payment requirements;
applicable booking policies;
the Guest Agreement;
Facility rules and policies; and
any additional requirements disclosed during the booking process.
A reservation is not guaranteed until confirmed through the applicable booking process. It is your responsibility to ensure that the email address and phone number associated with your reservation is accurate and current. We are not responsible for missed or undelivered confirmation emails resulting from incorrect account information, email filtering, or spam settings. Buffalo Baths may refuse, modify, cancel, or reschedule reservations as permitted by its current policies and the Guest Agreement.
4. Prices and Payment
Prices for reservations, services, packages, gift certificates, or other offerings will be displayed or communicated at the time of booking or purchase. All prices displayed on the website are in USD and are subject to applicable taxes, fees, and surcharges as required by applicable law. Any price changes will not affect bookings that have already been confirmed.
You agree to pay all charges associated with transactions you authorize.
Payments may be processed through third-party payment processors. Depending on the system used, Buffalo Baths may not directly receive or store complete payment-card information.
Website prices, descriptions, availability, or other information may occasionally contain typographical, technical, or other errors. Buffalo Baths may correct an error and, where reasonably necessary, modify or cancel an affected transaction.
If an error materially affects your transaction, Buffalo Baths will make reasonable efforts to notify you.
Gift cards purchases are subject to their own terms and conditions as presented at the time of purchase. Gift cards are non-transferable and not redeemable for cash, except as required by applicable law. Lost or stolen gift cards will not be replaced.
Any merchandise sales are final and merchandise is not eligible for return or exchange, except as required by applicable law or as otherwise determined by us in our discretion.
5. Cancellation, Rescheduling, Late Arrival, and Refund Policies
Reservations are subject to Buffalo Baths' then-current booking, cancellation, rescheduling, late-arrival, no-show, and refund policies.
Applicable policies may be displayed during booking or otherwise communicated before a reservation is completed.
The Guest Agreement separately addresses certain consequences associated with late arrivals, reservation modifications, safety-related termination, and circumstances beyond Buffalo Baths' reasonable control. Nothing in these Terms is intended to modify those provisions.
6. Guest Agreement
Your use of the physical Buffalo Baths facilities is separately governed by the Guest Agreement.
The Guest Agreement contains important terms concerning the risks associated with the Facilities and the legal rights and responsibilities of Buffalo Baths and its guests. Among other matters, the Guest Agreement addresses:
eligibility;
inherent and unavoidable risks;
assumption of risk;
medical acknowledgment;
alcohol, drugs, and impairment;
guest responsibilities and prohibited conduct;
release of liability;
covenant not to sue;
indemnification;
emergency medical authorization;
personal property;
damage to property;
photography and guest privacy;
neighbor and community expectations;
Buffalo Baths' right to refuse or terminate service;
reservation policies;
force majeure; and
other terms governing participation.
The Guest Agreement expressly provides that it affects a guest's legal rights and requires the guest to acknowledge having read, understood, and voluntarily accepted its terms. These Terms govern Website use, online transactions, and related interactions. The Guest Agreement governs access to, participation in, and use of the physical Facilities.
Nothing in these Terms modifies, supersedes, narrows, or replaces the Guest Agreement.
If there is a conflict between these Terms and the Guest Agreement concerning access to, participation in, or use of the Facilities, the Guest Agreement controls.
7. Health and Safety Information
Hot-water immersion and use of outdoor soaking facilities involve risks.
The Guest Agreement contains Buffalo Baths' applicable medical acknowledgment, health and safety provisions, assumption of risk, and participation requirements. Those provisions are incorporated into the guest relationship by reference but are not restated or modified by these Terms.
The Guest Agreement requires guests to independently evaluate their health and ability to participate and identifies circumstances under which consultation with a physician is recommended.
Information on the Website concerning wellness, health, safety, soaking, or similar topics is for general informational purposes only and is not medical advice.
8. Intake Information
Buffalo Baths may request information reasonably necessary to administer a reservation, facilitate a safe visit, address accessibility needs, or respond to guest preferences or concerns.
You agree to provide accurate information when completing required forms.
Buffalo Baths does not intend its intake process to replace your responsibility under the Guest Agreement to independently evaluate your ability to participate.
Information submitted through an intake form is handled in accordance with the Buffalo Baths Privacy Policy.
9. Facility Rules and Guest Conduct
Physical use of Buffalo Baths is governed by the Guest Agreement and applicable Facility rules.
The Guest Agreement requires guests to follow posted policies and staff instructions and establishes additional rules concerning safe use, noise, neighborhood conduct, parking, designated guest areas, impairment, harassment, property damage, and other conduct.
Nothing in these Website Terms modifies those obligations.
10. Acceptable Use of the Website
You may use the Website only for lawful purposes. You may not:
use the Website in violation of applicable law;
interfere with the operation, performance, or security of the Website;
attempt to gain unauthorized access to systems, accounts, networks, or data;
introduce viruses, malicious software, or harmful code;
scrape or systematically extract Website data or content without authorization;
use the website or any related data for the purposes of training or development of artificial intelligence technologies or machine learning models
impersonate another person;
knowingly provide materially false information;
use the Website to threaten, harass, defraud, or harm another person;
circumvent security or access controls; or
otherwise misuse the Website.
Buffalo Baths may restrict Website access when reasonably necessary to protect its systems, business, users, or others.
11. Intellectual Property
Unless otherwise stated, the Website and its content, including text, photographs, graphics, logos, branding, videos, design elements, and other materials, are owned by or licensed to Lovewood LLC or its content suppliers and may be protected by copyright, trademark, and other intellectual property laws.
You may access Website content for your personal, noncommercial use in connection with learning about or purchasing Buffalo Baths services.
You may not reproduce, distribute, modify, publish, sell, license, commercially exploit, or create derivative works from protected Website content without authorization, except as permitted by law, except for temporary copies stored in your web browser cache for personal, non-commercial use.
To the extent any aspect of the Website permits you to submit, post, or share content, you grant Buffalo Baths a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sublicensable right to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media. You represent and warrant that you own or have the necessary rights to submit such content, the content does not violate the rights of any third party, and the content will comply with any acceptable use guidelines and these Terms.
12. Feedback and User-Submitted Content
You may voluntarily provide Buffalo Baths with feedback, suggestions, reviews, photographs, testimonials, or other content.
You represent that you have the legal right to provide material you submit.
Submission of content does not automatically authorize Buffalo Baths to use your name, image, likeness, or testimonial for marketing where separate consent is required.
13. Third-Party Services
The Website may contain links to or integrations with services operated by third parties, including booking services, payment processors, mapping services, social media platforms, or other technology providers.
Third-party services are independently operated and may be governed by their own terms and privacy policies.
Buffalo Baths does not control and is not responsible for the independent practices, availability, security, or content of third-party services.
14. Website Availability
Buffalo Baths does not guarantee that the Website will be uninterrupted, error-free, or continuously available.
Website functionality may be affected by maintenance, updates, security matters, third-party service interruptions, technical problems, or circumstances outside Buffalo Baths' reasonable control.
Buffalo Baths may modify, suspend, or discontinue Website features when reasonably necessary.
15. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND WEBSITE CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
BUFFALO BATHS DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR FREE FROM HARMFUL COMPONENTS.
Nothing in this section limits a right or warranty that cannot lawfully be excluded.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LOVEWOOD LLC AND BUFFALO BATHS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO USE OF OR INABILITY TO USE THE WEBSITE.
Nothing in this section excludes or limits liability that cannot legally be excluded or limited.
Liability relating to participation in or physical use of Buffalo Baths is governed separately by the Guest Agreement.
Nothing in this section is intended to modify, replace, expand, or narrow the release of liability contained in the Guest Agreement.
17. Indemnification Relating to Website Use
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Lovewood LLC, Buffalo Baths, and their owners, members, managers, employees, contractors, agents, affiliates, successors, and assigns from claims, liabilities, damages, costs, expenses, and reasonable attorney fees arising from:
your unlawful use of the Website;
your material violation of these Terms;
your infringement of another person's rights;
your fraudulent or intentionally wrongful conduct; or
content you submit in violation of another person's rights.
This provision addresses Website-related conduct and does not modify the indemnification provision contained in the Guest Agreement.
18. Electronic Communications
By using the Website or providing an electronic contact method, you consent to receive electronic communications reasonably related to your reservations, transactions, agreements, or relationship with Buffalo Baths.
These communications may include:
reservation confirmations;
reminders;
changes or cancellations;
safety notices;
policy communications; and
administrative or transactional information.
Where Buffalo Baths separately provides an electronic acceptance or signature mechanism, that process may create a binding agreement to the extent permitted by applicable law.
The Guest Agreement contains its own electronic-signature provisions, which remain controlling for execution of that Agreement.
19. Privacy
The Buffalo Baths Privacy Policy explains how Buffalo Baths collects, uses, discloses, retains, and otherwise handles personal information.
20. Changes to These Terms
Buffalo Baths may update these Terms to reflect changes in its Website, business practices, technology, policies, or legal requirements. Updated Terms will be posted with a revised "Last Updated" date.
21. Governing Law and Venue
These Terms are governed by the laws of the State of Oregon without regard to its conflict-of-laws principles.
Any legal action arising from or relating to these Terms shall be brought in the state or federal courts located in Multnomah County, Oregon, unless applicable law requires otherwise. This provision is intended to remain consistent with the governing-law and venue provisions of the Guest Agreement.
22. Severability
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law.
23. Relationship of Documents
The Buffalo Baths relationship with guests may involve several separate documents, including:
these Website Terms of Use;
the Buffalo Baths Privacy Policy;
applicable booking or reservation policies;
any Guest Intake Form; and
the Guest Agreement, Release and Waiver.
Each document governs the subject matter addressed within it. Nothing in these Terms amends the Guest Agreement.
24. Accessibility
Buffalo Baths is committed to improving the accessibility of its website to all users, including those with disabilities. Our efforts to improve access are ongoing and include regular audits.
